By accessing or using our website and services, you ("Customer", "you") agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or services.

1. Definitions

  • "CFC Shipping LTD", "China 2 Curacao", "we", "our", "us": The operator of china2curacao.com and the provider of the logistics services.
  • "Customer", "you": The user of our website and services, including agents acting on behalf of the owner of the goods.
  • "Freight Forwarding Services": Transportation, handling, and logistics services provided by CFC Shipping LTD trading as China 2 Curacao for shipments from China to Curaçao.

2. Scope of Services

China 2 Curacao provides freight forwarding and logistics services for shipments from China to Curaçao, including optional insurance coverage. Our services include:

  • Warehouse receiving and storage in China
  • Package consolidation and sea freight shipping
  • Customs clearance documentation support
  • Shipment tracking and delivery coordination in Curaçao

All services are subject to these Terms unless otherwise agreed in writing.

3. Account Registration & Communication

To use our services, you must register a business account with accurate and current information, including a valid KVK (Chamber of Commerce) number. You agree to:

  • Provide accurate and complete registration information
  • Maintain the confidentiality of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

By using our services, you consent to receive electronic communications from us. Account approval is at the sole discretion of China 2 Curacao.

4. Use of Services

Services are for lawful freight forwarding and logistics only. You must not use our services for any unlawful or prohibited activities, including shipping items restricted by Chinese, Hong Kong, or Curaçao law. You are responsible for ensuring your shipments comply with all applicable laws and regulations.

5. Subcontractors and Third Parties

China 2 Curacao may engage third parties (e.g., carriers, warehouses, customs brokers) to perform all or part of the services. The terms and liability limitations of such third parties apply in addition to these Terms.

6. Customer Responsibilities & SOP Compliance

You must be the owner or authorized agent of the goods and warrant that all information and documents provided are complete, accurate, and lawful. Goods must be seaworthy packed and properly labeled.

6A. Client Identification Requirement

For all shipments, you must clearly and accurately include your assigned Client ID on all shipping documents and labels. Failure to include the correct Client ID may result in delays, storage fees, and administrative penalties.

6B. Pre-Alert Requirements

Customers must submit a pre-alert for each package before it ships from the seller to our warehouse. Pre-alerts must include:

  • Valid tracking number
  • Accurate description and declared value
  • Commercial invoice (pro-forma invoices are not accepted)
  • MSDS documentation for packages containing batteries or dangerous goods
  • Supplier/seller contact information

Packages received without a pre-alert will incur an additional handling fee.

6C. SOP Non-Compliance

Failure to comply with our Standard Operating Procedures — including but not limited to pre-alert submissions, correct labeling, Client ID requirements, and accurate documentation — releases China 2 Curacao from all liability for any resulting delays, loss, damage, storage fees, or administrative penalties. All risk arising from SOP non-compliance rests solely with the Customer.

7. Prohibited and Restricted Items

China 2 Curacao does not accept or transport items prohibited by law, including but not limited to: cash, drugs, firearms, hazardous materials, or counterfeit goods. Items containing batteries or hazardous materials must be declared and may incur additional charges. China 2 Curacao reserves the right to refuse any package at its discretion.

8. Shipment Handling and Inspection

Each shipment is treated as a separate consignment and may be inspected by China 2 Curacao and relevant authorities. We reserve the right to refuse or dispose of any shipment that is improperly declared or prohibited.

9. Customs and Import Duties

You are responsible for providing accurate and complete documentation for customs clearance. All customs duties, taxes, and fees imposed by Curaçao authorities are your responsibility. China 2 Curacao will provide documentation to support customs clearance but is not responsible for the assessment or payment of duties.

10. Offers, Pricing, and Payment

All offers are non-binding. Shipping rates are calculated based on volumetric measurement (CBM) with a minimum charge. Rates exclude duties, taxes, and insurance unless stated otherwise.

Payment is due in full before shipment planning or release. Only paid packages will be included in shipments. China 2 Curacao may retain goods until full payment is received. Shipments are planned only after payment has been confirmed.

11. Liability and Insurance

All services are performed at your risk.

China 2 Curacao will exercise reasonable care in handling your shipments. However, liability for loss or damage is limited to the declared value or, if not declared, to USD 2 per kg of gross weight lost or damaged, with a maximum of USD 5,000 per shipment.

We are not liable for:

  • Delays caused by customs, weather, port congestion, or other factors beyond our control
  • Damage to improperly packed items
  • Loss or damage of undeclared or undervalued items
  • Items seized by customs authorities
  • Delays, loss, or damage resulting from the Customer's failure to comply with Standard Operating Procedures

12. Claims and Limitation

Claims for loss or damage must be submitted in writing within 7 days of delivery. All claims against China 2 Curacao expire after 9 months from the date the claim arises.

13. Client Indemnity

You will indemnify and hold China 2 Curacao and CFC Shipping LTD harmless from any claims by authorities, third parties, or subcontractors arising from your shipment, unless caused solely by proven gross negligence on the part of China 2 Curacao.

14. Right of Retention and Pledge

China 2 Curacao has a right of retention and pledge on all goods, documents, and funds in its possession for all amounts due from you.

15. Force Majeure

We are not liable for delays, loss, or damage caused by circumstances beyond our reasonable control, including but not limited to war, strikes, natural disasters, pandemics, port closures, or government actions.

16. Special Conditions for Curaçao Shipments

Goods must be seaworthy packed. You are responsible for providing all required documents for customs exemption, including vehicle registration and proof of emigration where applicable.

18. Intellectual Property

All content on china2curacao.com is the property of CFC Shipping LTD or its licensors. Unauthorized reproduction, distribution, or use of any content is prohibited.

19. Account Termination

China 2 Curacao reserves the right to suspend or terminate accounts that violate these terms, provide false information, or engage in fraudulent activity.

20. Governing Law and Jurisdiction

These Terms are governed by the laws of Hong Kong. Any disputes shall be submitted to the courts of Hong Kong, unless otherwise agreed in writing.

21. Changes to Terms

China 2 Curacao may amend these Terms and Conditions at any time. Changes take effect 30 days after publication on our website. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
